Terms and Conditions

 Fox Ranch – Equine Sales Terms & Conditions

1. As-Is Sales:
   All horses are sold as is, where is, at the time of sale. No guarantees are expressed or implied regarding future soundness, performance, or disposition unless otherwise stated in writing. All vet work, maintenance and any known issues are always disclosed.

2. Pre-Purchase Examinations:
   Pre-purchase veterinary examinations are strongly encouraged and may be arranged at the buyer’s discretion and expense prior to completion of sale. Once payment is received, the horse is considered sold and ownership transfers immediately.

3. Deposits & Payment:
   A non-refundable deposit may be required to hold a horse. Full payment must be received before the horse leaves the property.

4. Liability Notice:
   In accordance with Texas Civil Practice and Remedies Code, Chapter 87, titled the Texas Equine Activity Limitation of Liability Act:

   “Under Texas Law (Chapter 87, Civil Practice and Remedies Code), an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities.”

5. Risk & Transportation:
   Risk of loss or injury transfers to the buyer upon completion of sale. Buyer assumes all responsibility for transportation, care, and safety of the horse once ownership has transferred.

6. If the listed horse has been consigned to a sale a $750 fee will be assessed in addition to price to PO from the sale (Charged to us by the Consignment Company to NO SALE the horse from the catalog. ) All sale consignment horses can be bid during the sales. (Reserve price is usually the price set in the ad)
